Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of the platform, websites, applications, microservices, API, and WordPress plugin operated by Hey Fardo LLC, a company incorporated in the State of Delaware (United States), with its address at 16192 Coastal Highway, Lewes, DE 19958, United States, and tax identification number (EIN) 39-3381900 ("Fardo", "we").
By registering an account, checking the acceptance box, installing the plugin, connecting an integration, or otherwise using the Services, you (the "User" or "Customer") represent that you have read, understood, and accepted these Terms and the Privacy Policy. If you do not agree, you must not use the Services.
If you accept on behalf of a company or organization, you represent that you have authority to bind it.
1. Definitions
- Services: Fardo’s SaaS platform for analyzing and optimizing brand visibility in AI engines, including the website, the application, the customer-facing backoffice, the community, the microservices, the APIs, and the WordPress plugin.
- Analysis / Score: the results, metrics (AEO, GEO, LLMO, "global score", share of voice, citations, etc.), rankings, benchmarks, insights, recommendations, and predictions generated by the Services.
- AI-Generated Content: text, files (e.g. llms.txt, JSON-LD, "AI feed", schema), summaries, drafts, and other material produced by artificial intelligence models through the Services.
- Third-Party Integrations: external services the User connects to Fardo (e.g. Google Analytics 4, Search Console, Shopify, WooCommerce, Mercado Libre, Notion, LinkedIn, Meta/Facebook/Instagram, Reddit, WordPress).
- Customer Data: information the User provides or connects, including data about its brand, domains, competitors, and data accessible through Integrations.
- Third-Party Data: information about brands, companies, or persons other than the User, obtained from public sources or data providers.
2. Purpose and description of the service
Fardo provides tools to measure and improve a brand’s visibility in search engines and artificial intelligence models. The Services may include: automated visibility analyses, scoring (AEO/GEO/LLMO), competitive analysis, generation of AI-optimized content, integrations with third-party platforms, content publishing, analytics, a professional community, and a WordPress plugin.
Fardo may modify, add, or discontinue features at any time, while striving not to materially affect the services contracted during an ongoing billing period.
3. Registration, account, and eligibility
3.1. To use the Services, the User must create an account through our identity provider and supply truthful, complete, and up-to-date information.
3.2. The User is responsible for the confidentiality of its credentials and for all activity carried out under its account. The User must immediately report any unauthorized use.
3.3. The User represents that it is of legal age and has the legal capacity to contract.
4. Plans, payments, renewal, and refunds
4.1. Plans. The Services are offered in free and paid plans (e.g. Starter, Growth, Enterprise), with the features and prices published at the time of purchase.
4.2. Payment processing. Payments are processed through Stripe, an external provider subject to its own terms. Fardo does not store your full card details.
4.3. Automatic renewal. Unless otherwise indicated, subscriptions renew automatically at the end of each period (monthly or annual) for an equivalent period, charging the then-current price. The User expressly authorizes these recurring charges upon purchase.
4.4. Cancellation. The User may cancel renewal at any time from its account or by writing to hola@heyfardo.com. Cancellation takes effect at the end of the paid period; the User retains access until that date.
4.5. Refunds. Except for any non-waivable right of withdrawal granted by applicable law, payments for periods already started are non-refundable. Where applicable consumer law grants a right of withdrawal/retraction, it will be honored under the terms of the law.
4.6. Taxes. Prices may not include taxes, which will be added as applicable.
4.7. Non-payment. Fardo may suspend or limit access in the event of rejected or overdue payments, upon reasonable notice.
5. Freemium model and usage limits
5.1. Some features are offered free of charge with limits (for example, one (1) free analysis per domain), which constitute the full scope of the free tier.
5.2. Promotional statements about the free tier (including "lifetime") refer to the scope described in these Terms and on the then-current pricing page, and may be modified going forward by updating the Terms, while respecting the free benefits already granted as of the date of the change.
5.3. Fardo may apply reasonable measures to prevent abuse of the free tier (e.g. association with the domain, frequency limits).
6. Nature of the analyses and artificial intelligence — no warranty of accuracy or results
6.1. Estimative nature. The Analyses, Scores, metrics, rankings, benchmarks, predictions, insights, and recommendations are generated through algorithms, third-party provider data, and non-deterministic artificial intelligence models. They constitute indicative estimates, may contain errors, inaccuracies, or results that vary between runs, and are not statements of fact or professional advice.
6.2. No guarantee of results. Fardo does not guarantee any commercial result, ranking, increase in visibility, traffic, sales, mentions, or improvement of any indicator. Any example, projection, or reference to other users’ results is merely illustrative and does not constitute a promise.
6.3. User decisions. The User is solely responsible for the business decisions it makes based on the Services. The User must verify the information before acting on it.
6.4. Technical "compliance". Where the Services indicate "compliance" or protocol validation (e.g. UCP/ACP for agentic commerce), this refers to technical conformity with a format or protocol, and does not constitute certification of legal, regulatory, or statutory compliance of the User’s products, catalogs, or activities.
6.5. Source of the data. Some metrics may derive from third-party provider data or system inferences. Fardo strives to use real sources but does not guarantee the availability, accuracy, or continuity of data from third parties.
7. Analysis of brands and third-party / competitor data
7.1. The Services may analyze and display information about brands, companies, and competitors other than the User, obtained from publicly accessible sources and data providers, as well as mentions generated by AI models.
7.2. Such information is provided for informational and analytical purposes, reflects estimates based on public sources, and does not imply affiliation, sponsorship, or endorsement of the mentioned brands by Fardo.
7.3. Fardo does not guarantee the accuracy of information about third parties. Analyzed brands may request the rectification or removal of information concerning them by writing to hola@heyfardo.com, and Fardo will assess such requests in good faith.
7.4. User responsibility for what it provides. When the User specifies domains, competitors, or data to analyze, it represents that it has the right/legitimacy to request such analysis and holds Fardo harmless against claims arising from the information it provides.
8. Third-party integrations and authorization to act on the User’s behalf
8.1. Connection. The User may connect Third-Party Integrations through OAuth or other mechanisms. By doing so, the User authorizes Fardo to access, retrieve, and process the data necessary to provide the Service (e.g. analytics, product catalogs, profiles, posts).
8.2. Publishing on the User’s behalf. If the User enables publishing features, it expressly authorizes Fardo to create, schedule, and publish content on its connected accounts (e.g. LinkedIn, Facebook, Instagram, Reddit, WordPress), including the automatic publishing of scheduled content without additional human intervention at the time of publication. The User is responsible for reviewing and approving content before scheduling it.
8.3. Compliance with platform terms. Use of the Integrations is subject to the terms of each third-party platform. The User undertakes to comply with them and acknowledges that Fardo is not responsible for suspensions, sanctions, or restrictions that platforms apply to the User’s accounts.
8.4. Credentials. Fardo applies reasonable security measures to safeguard the tokens and credentials of the Integrations. The User may revoke connections at any time from its account or from the third-party platform.
8.5. Availability. The Integrations depend on third-party services whose operation Fardo does not control; their interruption or change may affect the features.
9. AI-generated content and publishing responsibility
9.1. The Services may generate AI-Generated Content (text, llms.txt files, JSON-LD, "AI feed", social drafts, schema, etc.) that the User may publish on its own sites (including via the WordPress plugin) or on third-party platforms.
9.2. Mandatory review. AI-Generated Content may contain errors, inaccurate statements, or material that requires verification. The User must review and approve it before publishing and is solely responsible for the content it decides to publish under its domain or accounts.
9.3. Intellectual property of the content. The User is responsible for ensuring that the AI-Generated Content it publishes does not infringe third parties’ intellectual property, image, competition, or advertising rules.
9.4. Transparency. The User undertakes to comply with applicable rules on the identification of AI-generated content and undisclosed advertising on the platforms where it publishes.
10. User obligations and conduct
The User undertakes to:
- Use the Services in accordance with the law, these Terms, and the terms of the integrated platforms.
- Not use the Services for unlawful, defamatory, fraudulent, or harassing purposes, or to infringe the rights of third parties.
- Not attempt to access the systems without authorization, or perform reverse engineering, scraping, overloading, or interference with Fardo’s infrastructure.
- Ensure the lawfulness of the domains, data, and materials it provides or connects, and have the necessary authorizations regarding third-party data it enters into the platform.
- Not resell or redistribute the Services or their results without Fardo’s written authorization.
11. Intellectual property
11.1. Of Fardo. The Services, software, models, scoring methodologies, trademarks, logos, and interfaces are the property of Fardo or its licensors and are protected by law. These Terms do not transfer any intellectual property rights except for the limited license described herein.
11.2. License to use. Fardo grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Services for the duration of its account.
11.3. Output to the customer. Subject to the corresponding payment and compliance with these Terms, the User may use the AI-Generated Content and Analyses obtained for its internal business purposes. Fardo does not claim ownership of Customer Data.
11.4. Open-source software. Certain components (e.g. the WordPress plugin, licensed under GPL-2.0-or-later) are governed by their respective open-source licenses, which prevail with respect to those components.
12. User content and community
12.1. Applicability. This section applies to the Fardo Community and to any space where the User publishes content (posts, comments, reactions, profile) ("User Content").
12.2. License. The User retains ownership of its User Content and grants Fardo a worldwide, non-exclusive, royalty-free, and transferable license to host, display, reproduce, and distribute such content within the Services for the purpose of operating them.
12.3. Responsibility. The User is solely responsible for its User Content and represents that it has the necessary rights to it. Publishing unlawful, defamatory, infringing, offensive, spam, or privacy-violating content is prohibited.
12.4. Profile and directory. Certain profile information (e.g. name, company, role, professional link) may be displayed to other members. The User may manage the visibility of its profile according to the available options.
12.5. Moderation and reports. Fardo may moderate, edit, or remove User Content and suspend accounts that violate the rules. There is a reporting/notification channel (hola@heyfardo.com) to report infringing content, which Fardo will handle under a notice-and-takedown procedure.
13. Aggregated and anonymized data
13.1. Fardo may generate aggregated and anonymized statistical data from the use of the Services (e.g. industry benchmarks) that do not identify the User or any natural person.
13.2. The use of Customer Data to power shared-data features or benchmarks will require the User’s consent, given freely, specifically, and on an informed basis, and revocable at any time, without the User’s refusal conditioning access to the essential features contracted.
13.3. Fardo will apply reasonable anonymization techniques; the details of the processing are described in the Privacy Policy.
14. Limitation of liability and indemnity
14.1. "As is". The Services are provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability, to the maximum extent permitted by law.
14.2. Limitation. To the maximum extent permitted by applicable law, Fardo’s total liability to the User for any claim related to the Services will not exceed the amount actually paid by the User to Fardo in the twelve (12) months preceding the triggering event. Fardo will not be liable for indirect damages, lost profits, loss of data, opportunities, or reputational harm.
14.3. Exclusions. Fardo is not liable for: (i) User decisions based on Analyses or AI-Generated Content; (ii) suspensions or sanctions applied by third-party platforms; (iii) content published by the User; (iv) interruptions of third-party services; (v) misuse of the Services by the User.
14.4. Indemnity. The User will hold Fardo harmless against third-party claims arising from: its User Content, the data or domains it provides, the content it publishes, the breach of third-party platform terms, or the use of the Services in violation of these Terms or the law.
14.5. No provision limits liabilities that cannot be legally excluded (e.g. willful misconduct, personal injury, non-waivable consumer rights).
15. Privacy and data protection
15.1. The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.
15.2. Where Fardo processes personal data on behalf of the User (e.g. data accessible via Integrations or data of the User’s end users), the parties will enter into a Data Processing Agreement (DPA) in which Fardo acts as processor and the User as controller.
15.3. Fardo uses subprocessors (e.g. AI, authentication, payment, infrastructure, and messaging providers) listed in the Privacy Policy.
16. Suspension and termination
16.1. The User may stop using the Services and close its account at any time.
16.2. Fardo may suspend or terminate access in the event of breaches of these Terms, non-payment, fraudulent use, or security risks, seeking to provide reasonable notice except in cases of urgency.
16.3. Effects. Upon termination, the license to use ceases. The User may request the export or deletion of its data in accordance with the Privacy Policy and applicable legal retention periods. Clauses that by their nature must survive (IP, limitation of liability, indemnity, governing law) will remain in force.
17. Modifications to the Terms
17.1. Fardo may modify these Terms. Material changes will be notified by reasonable means (e.g. email or notice on the platform) with reasonable advance notice.
17.2. Continued use of the Services after the changes take effect implies acceptance. If the User does not accept them, the User must stop using the Services.
18. Governing law, jurisdiction, and dispute resolution
18.1. These Terms are governed by the laws of the State of Delaware, United States of America, without giving effect to its conflict-of-laws rules.
18.2. Any dispute will be submitted to the competent state or federal courts located in the State of Delaware, without prejudice to the non-waivable rights that applicable consumer law grants to the consumer User in its domicile.
18.3. The parties will seek to resolve any dispute in good faith through prior negotiation before initiating legal action.
19. General provisions
19.1. Entire agreement. These Terms, together with the Privacy Policy and the applicable annexes (DPA, Subscription Terms, Community Guidelines), constitute the complete agreement between the parties.
19.2. Assignment. The User may not assign its rights without Fardo’s consent; Fardo may assign them in the context of a reorganization or transfer of assets.
19.3. Severability. The invalidity of one clause does not affect the validity of the remaining ones.
19.4. No waiver. The failure to exercise a right does not imply its waiver.
19.5. Notices. Notices to Fardo will be sent to hola@heyfardo.com; to the User, to the contact details of its account.
19.6. Languages. In the event of discrepancy between language versions, the Spanish version will prevail.
